January 2020 - Costly Divorce Mistakes

Costly Divorce MistakesI’m often asked, “How much will my divorce cost?” There are several factors that can influence the cost of your divorce, including:

  • The process you use and/or professionals you hire;
  • Where you live;
  • How complicated your case is; and
  • The extent of cooperation, or lack of, between you and your soon-to-be ex.

To help control the expense, if possible, work with your spouse to reach agreements on property and asset distribution or parenting arrangements. But certainly, what you don’t want to do is make mistakes that will add to the expense of your divorce. Some of the more common mistakes are:

  1. Not consulting a lawyer – Lawyers know the procedures and etiquette to follow in court and can help you navigate your proceedings appropriately. A lawyer can also foresee potential issues in the future and can draft a comprehensive and lasting agreement that may avoid subsequent issues and avoid further legal fees and costs.
  2. Not having your paperwork ready – Proof of your income as well as your debts will back up your requests whether you’re looking for financial support or for a reduction in the amount of support you pay.
  3. Not being reasonable or honest – Judges don’t view it favorably if you are unreasonable or overreach in your requests. If you need $1,000 a month, don’t ask for $2,000. If you have a certain amount in financial assets, be honest about the numbers.
  4. Not respecting the judge’s time – Everyone gets their chance to speak but when the judge is talking, it’s your turn to listen. Remember to turn off your cellphone to avoid annoying interruptions. Be on time and don’t make the Court wait..
  5. Not controlling your attitude – Giving the Judge, court personnel or your future ex- spouse an attitude won’t win any friends. Control your anger and be polite.

Divorce can be an emotional rollercoaster but keeping your emotions in check while in the courtroom can help expedite your proceedings which, in turn, can lower the cost of your divorce.

I am an attorney and have practiced law for 26 years. I hired Vic to handle a very difficult family matter because I do not handle family law. Vic was extremely competent and obtained a result far beyond my expectations. Without his counsel my son's and family's life would have been changed forever. Thank you Vic for your good lawyering. I very much appreciate the personal attention and time dedicated to this matter. I highly recommend Vic.

We recently had a situation where we needed to hire an attorney. We selected Rotolo Law Firm and I can honestly say that we were above and beyond satisfied with Vic and his team. We would absolutely recommend this firm to anyone should the need arise. We blindly picked the firm out of the phone book because I liked his ad. Now I believe that God was pointing us in the right direction. Thank you Vic and the Rotolo Law Firm for being there for us in our time of need.

Victor's expertise, due diligence, and empathy for his client made my first experience with the law (and last) a non-stressful one. Before the case, I did my research and looked over about 20 lawyers before choosing Victor. All my sources pointed to him as the best and they weren't off even a bit. Victor treated my case like it was his own and kept me up to date with all my appointments, breakthroughs in the case, and guided me step through step in a process that I never thought that I had to come to endure. If Victor's not available Susy will go out of her way to take care you. The productivity and efficiency in that office is second to none. Thank you Victor!
